Moving and child custody: Things to keep in mind

When going through the divorce process, you should never lose sight of the steps you can take to make things easier on your children. If you have physical custody of your children, it means they'll primarily live with you in your home.

There may come a point when you want to move. While you don't have much to think about if you're moving within the same general area, there are many details that come into play if you're leaving the city, state or country.

Here are some things to consider:

  • How far do you want to move? If you share custody with your ex-spouse, moving a far distance away from them can make it difficult from a visitation perspective. You need to check with the court on what you can and can't do, as well as the type of notice you have to give the other parent.
  • Do you plan to take your children with you? It sounds strange, but this can come into play in some situations.
  • Have you discussed this with your children? Your children may not be interested in moving away from their home. You may have no choice but to pursue the move, such as for employment, but it still makes sense to consult your children to better understand their feelings.

When it comes to relocation and child custody, you can't afford to overlook anything of importance. Assuming you can make a move without letting anyone know is a mistake.

It doesn't matter if you have physical custody or are the noncustodial parent, be sure to understand your legal rights in regard to relocation.
