How it works

Mediation has been gaining steadily in popularity. In fact, by Illinois law, if the divorcing couple has minor children, mediation is mandatory. In this process, the mediator is a neutral third party who helps the spouses negotiate their own divorce agreement. The mediator does not take sides. He or she has professional training to help the parties communicate with each other and work out the details of their agreement.

Mediation meetings take place outside of court. They are private and confidential, and you will not have to trust your circumstances to the decisions of a judge. In addition, where litigation can often drag on for months, the mediation process moves much more quickly. Because it takes less time, you will also save on attorney’s fees and avoid court costs, which include filing fees, witness fees and more.

Lack of future issues

You and your spouse may have tried to save your marriage, but it was not to be. If you can still interact in a reasonable way without becoming spiteful or hostile, the concept of mediation may be appealing. Since you both have direct input into the final agreement, the likelihood of returning to court due to post-divorce problems is low.

Mediation is also easier on children than litigation, which can turn into a battle and lead to bitterness among family members. At the end of the day, your marriage may be over, but your relationship will probably survive, in some form, for years, if not forever.
