Are you entitled to receive spousal support?

As you proceed with your divorce, you may soon come to realize that your financial circumstances are changing in many ways. You may be entitled to receive spousal support.

This comes into play if you are unable to meet your financial needs without the assistance of your spouse who has the means to make regular payments.

There are times when spousal support is temporary, such as if you need time to find a job or receive training/education that will allow you to land employment in the future. There are also times when permanent spousal support comes into play, often with older or disabled spouses who will need long-term support.

If you believe that you're entitled to spousal support, here are seven questions to consider:

  1. How long did your marriage last?
  2. Are you and/or your spouse currently employed?
  3. How much money do you and your spouse each earn?
  4. How many years during your marriage were you employed either full or part-time?
  5. What is your highest level of education?
  6. Did you quit your job during your marriage to stay at home with your children?
  7. Do you have a prenuptial agreement that could impact your ability to receive spousal support payments?

There is no way of knowing for sure if you're in position to receive spousal support after divorce. The best thing you can do is answer the questions above, among others, and discuss the matter with your Chicago family law attorney. Experienced attorneys can help their clients seek the spousal support they need to move forward in their lives after their divorce.
